What's different about Texas

Texas has a dram shop act with a safe harbor

The Texas Dram Shop Act (Alco. Bev. Code ch. 2) imposes liability for serving someone obviously intoxicated to the point of danger. Texas also gives a safe-harbor defense when your staff is TABC-certified, which is both a legal shield and a pricing credit. If you serve alcohol, carry liquor liability and get your staff certified.

Texas is the only state where workers' comp is voluntary for private employers. Most restaurants carry it anyway, because going without means unlimited injury-lawsuit exposure.

Coastal Texas wind is its own market
